PROCESSING YOUR ORDER
We aim to despatch orders within five working days (Monday to Friday). We try to keep the stock availability as up to date as possible but there may be the rare occasion when we have sold out of an item showing as available on the site. If a suitable substitute is available we will replace with that item.  Please allow 30 days for delivery of your order. You will receive an automatically generated email from us when your order has been processed confirming an order number and an automatically generated email from Sage Pay our Payment Gateway giving details of the transaction number. On completion of your order an automatically generated email will be sent to you advising you that your order has been completed.  We reserve the right to refuse any order for any reason.

PRICES
The price you pay is the price on our website at the time we receive your order. All prices are quoted in Pounds Sterling (£) and include Value Added Tax (VAT) (where applicable) at the appropriate current rates.

PAYMENT
We must receive full, cleared payment for an order before we despatch the goods. You can pay using any major credit or debit card, Amex or PayPal.  All transactions are subject to authorisation by the card issuer. We will never ask you to confirm any payment details via email as we do not hold your card details. If you receive an email claiming to be from lochnessgifts.com asking you to do so please ignore it and do not respond.

If you are placing an order with us from outside the UK please advise your bank of the transaction as this could prevent any delays with the authorisation of the payment.

PRIVACY POLICY
We do not hold your card details and we only use your personal information to process your order. We will never give or sell your personal details to any third party. We are a registered data user with the Information Commissioner’s Office under the Data Protection Act 1998. Our Registration Number is Z7986697.

Our website has the very latest security features to protect you against card fraud. Our Payment Service Provider (PSP) is Sage Pay, the largest independent payment service provider in the UK and Ireland. All financial transactions through Sage Pay are encrypted using internationally recognised 256-bit encryption standards. Sage Pay are audited annually under the Payment Card Industry Data Security Standards (PCI DSS) and is a fully approved Level 1 payment services provider, which is the highest level of compliance. Sage Pay are also active members of the PCI Security Standards Council (SSC) that defines card industry global regulation. They are also regularly audited by the banks and banking authorities to ensure that their systems are impenetrable. In addition, you know that your session is in a secure encrypted environment when you see https:// in the web address, and/or when you see the locked padlock symbol alongside the URL so when buying through our site, you can be sure that you are completely protected.

COOKIE POLICY
Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item to purchase. The shopping cart system uses cookies to help maintain your shopping cart while you browse our store. No other information is stored in the cookies, and the cookies are not used for any other function but shopping. The cookie generated for the shopping cart purpose is deleted when the financial transaction is complete.

UK DELIVERY
Orders may be sent in one or more delivery and a signature may be required. All UK orders will be sent by Royal Mail Second Class Post. In the unlikely event that your order does not arrive please wait 30 days before submitting a claim to us, we are unable to despatch a replacement or issue a refund until this period of time has elapsed. If you have ordered a large item, please check that your local Post Office is not holding it for collection or redelivery if no-one was at home to accept the item when delivery was initially attempted. If Royal Mail are unable to deliver your order for any reason our address is on all items and will be returned to us. In adverse weather these timescales may have to be extended but we will take guidance from Royal Mail should that situation arise.

INTERNATIONAL DELIVERIES
Orders may be sent in one or more delivery and a signature may be required. International mail will be sent by Royal Mail’s International Standard service but the actual delivery of your items will be the responsibility of the postal service in the country the items are going to. Please wait 30 days before submitting a claim to us, we are unable to despatch a replacement or issue a refund until this period of time has elapsed. If your order was unable to be delivered for any reason our address is on all items and will be returned to us. In adverse weather these timescales may have to be extended but we will take guidance from Royal Mail should that situation arise.

When ordering goods from us for delivery outside of the European Union, you may be subject to import duties and taxes, which are levied once the package reaches your country. We have no control over these charges and they must be borne by you. We would also like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

For goods ordered and sent to a different address as a gift for a third party the contents and cost will be listed on the relevant Customs Labels attached to the package.

RETURNS POLICY

Your right to cancel
Your right to cancel an order for starts the moment you place your order and ends 14 days from the day you receive your goods. To cancel you must inform us in writing by email or letter (not telephone) and return the goods to us in a re-saleable condition at your own risk and cost within 14 days. We will refund your card with the cost of the returned item within 14 days of receiving the goods back. We cannot accept the return of CD’s and sweets if the seals have been broken or underwear and earrings unless they are damaged or faulty.

DAMAGED/FAULTY GOODS
In the unlikely event your goods are received damaged or faulty, please inform us in writing by email or letter within 24 hours and we will arrange for the damaged item(s) to be collected and replaced at our expense. If this isn’t practical we will ask for a photo of the damaged item to be emailed to us before we dispatch a replacement or a refund.

Your use of this website is governed by these Terms and Conditions. By placing an order on this website you agree to be bound by the Terms and Conditions. The contract to purchase shall be concluded in English. Scottish Law will govern the contract between us. We may make changes to the above Terms and Conditions without informing you, however these changes will only affect any subsequent orders you place with us. We strongly advise you to print a copy of these Terms and Conditions.
